Terms of Service

1. Acceptance

By creating an account or using the MemoryAI API, you agree to these Terms.

2. Service Description

MemoryAI provides persistent long-term memory for AI agents: memory storage and retrieval, neural graph, background processing (decay, consolidation, tiering), Context Guard, Emotion Engine, MCP server, and SDKs.

3. Accounts & API Keys

• You are responsible for keeping your API key secure.
• Do not share API keys publicly.
• One account per person or organization.
• We may revoke keys that violate these terms.

4. Acceptable Use

You agree NOT to: store illegal content; use for spam or phishing; bypass rate limits; reverse engineer the service; store unencrypted sensitive data (SSN, credit cards, passwords).

5. Plans & Pricing

• Free: 500 memories, 14-day retention, 100 stores/day.
• Pro ($19/mo): 50,000 memories, 90-day retention, full brain features.
• Team ($49/mo): 500,000 memories, 1-year retention, multi-agent.
• Enterprise (custom): Unlimited, SLA, dedicated support.
• Prices may change with 30 days notice. Pro includes 30-day free trial.

6. Data Ownership

Your data is yours. We don't claim ownership. We don't use your data to train AI models. You grant us a limited license to process data solely for providing the service.

7. DNA-Protected Memories

DNA memories (preference, decision, identity) are never automatically deleted, only deletable with force=true, and preserved during plan downgrades.

8. Service Availability

Target 99.9% uptime for paid plans. Free: best-effort. Not liable for third-party outages.

9. Cancellation

Cancel anytime. Data retained 30 days. Export via GET /v1/export. Refunds within 7 days of first payment.

10. Limitation of Liability

Service provided "as is". Not liable for data loss, incorrect recall, or third-party outages. Total liability limited to amount paid in last 12 months.

11. Governing Law

Governed by laws of Vietnam. Disputes resolved in courts of Hanoi.
